WHAT ARE THE ELIGIBILITY REQUIREMENTS TO APPLY FOR INDEFINITE LEAVE TO REMAIN ON THE BASIS OF LONG RESIDENCE?

In order to be eligible for Indefinite Leave to Remain on the basis of Long Residence, you must:

  • Have leave to remain in the UK at the date of Application;
  • Be legally resident in the UK for 10 continuous years;
  • Have kept to the terms of your current leave to remain in the UK;
  • Pass the Life in the UK Test;
  • Evidence that you satisfy the English Language requirement;
  • Not have been absent from the UK for more than 540 days throughout the 10 continuous years of residence;
  • Not fall for refusal under the general grounds of refusal;
  • Not be in the UK in breach of Immigration Laws.

When the Home Office is assessing your Application for a Long Residence Visa, the following matters will also be considered:

  • Your age;
  • The strength of your connections in the UK;
  • Your personal history, including character, conduct, associations and employment record; 
  • Your domestic circumstances; 
  • Any compassionate circumstances; 
  • Any representations received on your behalf.

CAN MY DEPENDENTS APPLY FOR INDEFINITE LEAVE TO REMAIN ON THE BASIS OF LONG RESIDENCE IN THE SAME APPLICATION? 

Your family members (dependents) will have to apply separately as you cannot include your family members in your Application. 

Your family members will also have to satisfy the eligibility requirements to apply for Indefinite Leave to Remain in the UK on the basis of Long Residence.

If your partner is not eligible to apply separately and you were successfully granted with Indefinite Leave to Remain, your partner may be able to apply to remain in the UK as the Partner of a Settled Person. 

If your child is not eligible to apply separately and you were successfully granted with Indefinite Leave to Remain, you may be able to include them in your Application as your dependant if you apply to settle under another Visa Category.
